Resumo:

A concepção de justiça de Henrique C. de Lima Vaz é uma retomada do realismo jurídico clássico, reelaborado pelo filósofo jesuíta à luz de conceitos modernos como “dignidade” e “reconhecimento”. Em sua visão, a justiça é a categoria ética que articula a disposição subjetiva para a ação reta, ou virtude, com a medida objetiva dos direitos, ou lei. A dignidade humana, por sua vez, consiste no reconhecimento igual e não na supervalorização do ego na coexistência, como se vê em muitas demandas jurídicas hodiernas. Por fim, o Estado democrático não é mero instrumento de satisfação de carências e de igualação dos indivíduos, mas veículo da liberdade participante e garantia da efetiva partilha do poder entre os cidadãos.

Abstract:

Henrique C. de Lima Vaz´s theory of justice is a continuation of classic legal realism, reworked by the Jesuit philosopher in the light of modern concepts such as “dignity” and “recognition”. In his view, justice is the ethical principle that articulates the subjective disposition to right actions, or virtue, with the objective measure of rights, or law. Human dignity, in turn, lies in equal recognition, not in an overvaluation of the ego in social life, as we can see in many legal cases today. Lastly, the Democratic State is not merely an instrument to satisfy human needs and equalize individuals, but a vehicle for participatory freedom and the guarantee of the effective distribution of power among citizens.
